STORE POLICY

§ 1

Preliminary Provisions

  1. The online store, didactico.pl, is operated by Emanuel Pukacka, who conducts business under the name “Speak Up Centrum Języka Angielskiego Emanuela Pukacka,” registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for the economy, NIP: 5961668380 , REGON: 384183767.
  2. These Terms and Conditions are intended for both Consumers and Business Customers using the Store and set forth the rules for using the Online Store, as well as the rules and procedures for entering into distance sales contracts with Customers through the Store.

§ 2

Definitions

  1. Consumer – a natural person who enters into a contract with the Seller through the Store, the subject matter of which is not directly related to the consumer’s business or professional activities.
  2. Seller – a natural person conducting business activity under the name “Speak Up English Language Center – Emanuela Pukacka,” registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for the economy , Tax Identification Number (NIP): 5961668380 , National Business Registry Number (REGON): 384183767 .
  3. Customer – any entity making purchases through the Store.
  4. Entrepreneur – a natural person, a legal entity, or an organizational unit that is not a legal entity but is granted legal capacity by a separate law, which conducts business activities in its own name and uses the Store.
  5. Store – the online store operated by the Seller at the web address didactico.pl
  6. Distance Contract – a contract concluded with a Customer as part of an organized system for concluding distance contracts (through the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to and including the moment the contract is concluded.
  7. Terms and Conditions – these Terms and Conditions of the Store.
  8. Order – a declaration of intent by the Customer made using the Order Form and intended directly to conclude a Sales Agreement for a Product or Products with the Seller.
  9. Account – the customer’s account in the Store, which contains the data provided by the customer and information about the Orders placed by the customer in the Store.
  10. Registration Form – a form available in the Store that allows you to create an Account.
  11. Order Form – an interactive form available in the Store that allows you to place an Order, specifically by adding Products to the Cart and specifying the terms of the Sales Agreement, including the delivery and payment methods.
  12. Shopping Cart – a feature of the Store’s software where the Products selected by the Customer for purchase are displayed, and where the Customer can specify and modify Order details, particularly the quantity of products.
  13. Product – a tangible item or service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.
  14. Sales Agreement – an agreement for the sale of a Product entered into or concluded between the Customer and the Seller through the Online Store. The term “Sales Agreement” also refers to—depending on the characteristics of the Product—a service agreement and a contract for specific work.

§ 4

Technical Requirements

  1. To use the Store—including browsing the Store’s product selection and placing orders for Products—you must:
    1. a device with Internet access and a web browser such as Internet Explorer, Firefox, Chrome, Safari, or Opera;
    2. an active email account,
    3. Cookies are enabled

§ 5

General Information

  1. To the fullest extent permitted by law, the Seller shall not be liable for disruptions, including interruptions in the Store’s operation, caused by force majeure, unauthorized actions by third parties, or the Online Store’s incompatibility with the Customer’s technical infrastructure.
  2. You do not need to create an Account to browse the Store’s product selection. Customers may place orders for Products available in the Store’s selection either by creating an Account in accordance with the provisions of § 6 of the Terms and Conditions or by providing the necessary personal and shipping information to complete the Order without creating an Account.
  3. The prices listed in the Store are in Polish zlotys and are gross prices.
  4. The final amount payable by the Customer consists of the price of the Product and the shipping cost (including transportation and delivery fees), which is disclosed to the Customer on the Store’s website during the Order placement process, including at the time the Customer expresses their intent to be bound by the Sales Agreement.
  5. In the case of a contract for the provision of services for an indefinite period, the final price is the total price covering all payments for the billing period.
  6. If, based on a reasonable assessment, the nature of the subject matter of the Agreement does not allow for the final price to be calculated in advance, information regarding how the price will be calculated, as well as information regarding shipping and delivery charges and other costs, will be provided in the Store in the Product description.

§ 6

Creating an Account in the Store

  1. To create an account in the Store, please fill out the order form—an account will be automatically created using the email address you provide when placing your order. You must provide the following information:
    1. First and Last Name
    2. Residential Address
    3. Phone Number
    4. Email address
  2. Creating an account in the store is free.
  3. To log in to your account, enter the username and password you provided on the registration form.
  4. The Customer may, at any time, without providing a reason and without incurring any fees, delete their Account by sending a request to that effect to the Seller, in particular via email or in writing to the addresses specified in § 3.

§ 7

Order Placement Guidelines

To place an order, please:

  1. log in to the Store (optional);
  2. Select the Product that is the subject of the Order, and then click the “Add to Cart” button (or an equivalent button);
  3. Log in or fill out the Order Form—an account will be created automatically;
  4. Fill out the Order Form by entering the recipient’s information and the address to which the Product is to be delivered, select the shipping method (how the Product will be delivered), enter any billing information, select one of the available payment methods and click the “Buy and Pay” button (or equivalent), after which you must pay for the order

§ 8

Available Shipping and Payment Methods

  1. The customer may choose from the following delivery methods for the ordered Product:
    1. Delivery is carried out by a courier that provides delivery services for the Seller.
  2. Customers can use the following payment methods:
  1. Electronic payments processed by the Przelewy24 service, owned by PayPro S.A.
  2. Detailed information about delivery methods and accepted payment methods can be found on the Store’s website.

§ 9

Performance of the Sales Contract

  1. A Sales Agreement between the Customer and the Seller is concluded after the Customer has placed an Order using the Order Form in the Online Store, in accordance with § 7 of the Terms and Conditions.
  2. After an Order is placed, the Seller immediately confirms receipt of the Order and, at the same time, accepts the Order for processing. Confirmation of receipt of the Order and its acceptance for processing occurs when the Seller sends the Customer an appropriate e-mailto the Customer’s email address provided when placing the Order, which contains at least the Seller’s statements regarding receipt of the Order and its acceptance for fulfillment, as well as confirmation of the conclusion of the Sales Agreement. Upon the Customer’s receipt of the aforementioned email, a Sales Agreement is concluded between the Customer and the Seller.
  3. If the Customer chooses:
    1. For payments by bank transfer or electronic payment, the customer is required to make the payment at the time of placing the order,
  4. The product will be shipped by the Seller within the timeframe specified in its description (subject to subsection 5 of this paragraph), using the shipping method selected by the Customer when placing the Order.
  5. If you order Products with different delivery dates, the delivery date is the latest date specified.
  6. If you order Products with different readiness dates, the readiness date is the latest date specified.
  7. Product delivery is available only within Poland.
  8. Delivery of the Product to the Customer is subject to a fee, unless the Sales Agreement provides otherwise. The costs of delivering the Product (including fees for transportation, delivery, and postal services) are disclosed to the Customer on the Online Store’s website under the “Payment and Delivery” tab (or an equivalent tab) and during the Order placement process, including at the moment the Customer expresses their intention to be bound by the Sales Agreement.

§ 10

Right to Cancel the Contract

  1. A customer who is a consumer and who has entered into a sales contract may withdraw from it within 14 days without giving any reason, in accordance with the Consumer Rights Act of May 30, 2014. (Journal of Laws of 2014, item 827, as amended) “A consumer who has entered into a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring any costs, except for the costs specified below…”.
  2. The Seller is entitled to withdraw from the Agreement in the following cases:
    1. the occurrence of a force majeure event that prevents the performance of the Agreement,
    2. to withdraw the posted offer if the Consumer has not agreed to an alternative regarding the Order,
    3. the Customer provides an incorrect or unreachable phone number or shipping address.
  3. If either party withdraws from the Agreement, it shall be deemed never to have been concluded. The Seller shall refund the payment made by the Consumer using the same payment method that the Consumer used.
  4. If the Customer places a fraudulent Order or fails to perform the Agreement (in particular, by failing to pay for it or by failing to be present at the delivery location or pickup point to collect the ordered products), the Seller is entitled to refuse to accept any future Orders from such a Customer.
  5. The Seller is entitled to immediately reject Orders placed by the Customer if there is reasonable doubt as to their correctness or authenticity. If the Seller rejects an Order that has already been paid for, the Seller will transfer the amount paid back to the account from which the payment was made. In the event of a reasonable suspicion that a crime has been committed, the Seller is obligated to report this fact to the appropriate law enforcement authorities.
  6. The Consumer does not have the right to withdraw from a Sales Agreement with respect to a contract:
    • where the subject of the service is a non-prefabricated item, manufactured according to the Consumer’s specifications or intended to meet the Consumer’s individual needs;
    • where the subject of the service is an item that spoils quickly or has a short shelf life;
    • where the subject of the service is an item delivered in sealed packaging that cannot be returned once the packaging has been opened for health or hygiene reasons, if the packaging was opened after delivery;
    • in which the subject matter of the service consists of goods that, upon delivery, due to their nature, become inseparably combined with other goods;
    • where the subject of the service consists of audio or video recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery;
    • for the delivery of newspapers, periodicals, or magazines, except under a subscription agreement;
    • in which the price or remuneration depends on fluctuations in the financial market over which the business has no control and which may occur before the deadline for withdrawing from the contract;
    • for the supply of digital content that is not stored on a tangible medium, if the performance of the service began with the Consumer’s express consent before the expiration of the withdrawal period and after the business had informed the Consumer of the loss of the right to withdraw from the contract;

§ 11

Complaints and Warranty

  1. The Sales Agreement covers new Products.
  2. The seller is obligated to deliver goods free from defects to the customer.
  3. If a defect is found in goods purchased from the Seller, the Customer has the right to file a complaint in accordance with the warranty provisions of the Civil Code.
  4. Complaints must be submitted by phone, in writing, or electronically to the Seller’s addresses provided in these Terms and Conditions.
  5. It is recommended that the complaint include, among other things, a brief description of the defect, the circumstances (including the date) under which it occurred, the details of the customer filing the complaint, and the customer’s request regarding the defect in the goods.
  6. The seller will respond to the complaint within 14 days; if the seller fails to do so within that time, the customer’s complaint will be deemed unfounded.
  7. Goods returned as part of the complaint procedure should be sent to the address specified in § 3 of these Terms and Conditions.
  8. If a warranty has been provided for the Product, information about it, as well as its terms, will be included in the Product description in the Store.

§ 12

Out-of-court methods for handling complaints and pursuing claims

  1. The customer is required to contact the Seller first. The Seller will make every effort to resolve the matter amicably.
  2. The customer has the right to use out-of-court methods for resolving complaints and pursuing claims. To do so, the customer may file a complaint through the EU’s ODR online platform, available at: http://ec.europa.eu/consumers/odr/.
  3. The company reserves the right to require prior consent for the use of other alternative dispute resolution mechanisms.

§ 13

Personal Information in the Online Store

  1. The Seller is the controller of the Customers’ personal data collected through the Online Store.
  2. The personal data of Customers collected by the controller through the Online Store is collected for the purpose of performing the Sales Agreement and, if the Customer consents, also for marketing purposes.
  3. The recipients of the personal data of the Online Store’s customers may include:
    1. In the case of a Customer who selects delivery by mail or courier service in the Online Store, the Administrator shares the Customer’s collected personal data with the selected carrier or intermediary handling shipments on behalf of the Administrator.
    2. In the case of a Customer who uses electronic payment methods or a payment card in the Online Store, the Administrator shares the Customer’s collected personal data with the selected entity that processes such payments in the Online Store.
  4. The customer has the right to access and correct their data.
  5. The provision of personal data is voluntary; however, failure to provide the personal data specified in the Terms and Conditions that is necessary to conclude the Sales Agreement will result in the inability to conclude said agreement.

§ 14

Final Provisions

  1. Contracts concluded through the Online Store are drawn up in Polish.
  2. The Seller reserves the right to amend these Terms and Conditions for valid reasons, namely: changes in the law, changes in payment and delivery methods—to the extent that such changes affect the implementation of the provisions of these Terms and Conditions.
  3. In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the Provision of Electronic Services; the Consumer Rights Act; and the Personal Data Protection Act.
